Mr. Munch had a fantastic result in a 7-day hearing which occurred over a period of 2 months and secured an award of costs in the amount of $40,000.
Mr. Munch capably defended the rights of our clients before the Normal Farm Practices Protection Board (“NFPPB”). The Board dismissed the applicants’ application in its entirety. In addition, the Board found that the applicants frivolously commenced the application, raised additional issues during the proceedings and failed to bring evidence to substantiate these issues, attempted to malign and vilify our clients, served an excessive number of documents onto our clients many of which were irrelevant and for no purpose, brought numerous motions many of which were unsuccessful, vexatious and costly and delayed the proceedings, and delayed the proceedings by their repeated allegations of bias. As a result, the Board awarded our clients costs in the amount of $40,000 plus interest after 30 days at the Court of Justice Act post-judgement rate.
